1. Agreement to Terms
By accessing and using the Caloria mobile application ("App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this App.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Medical Disclaimer
IMPORTANT: The App is not a medical device and does not provide medical advice.
The nutritional information, calorie counts, macro-nutrient data, and other content provided by the App are estimates generated by Artificial Intelligence and should be used for informational purposes only.
- Estimates Only: While we strive for accuracy, AI analysis of food images can be imperfect.
- No Professional Advice: The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
- Consult a Doctor: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or dietary changes. Never disregard professional medical advice or delay in seeking it because of something you have read on this App.
3. User Accounts
To access certain features of the App, you may be required to create an account.
- Security: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your mobile device.
- Responsibility: You agree to accept responsibility for all activities that occur under your account.
- Accuracy: You agree to provide accurate and complete information when creating an account.
4. Intellectual Property
The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Caloria and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.
5. User Content
You retain all rights to any images, text, or data you upload to the App ("User Content").
- License: By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process such content solely for the purpose of providing the service to you (e.g., analyzing food images to provide nutritional data).
- Responsibility: You are solely responsible for the User Content you upload. You agree not to upload content that is illegal, offensive, or violates the rights of others.
6. Prohibited Activities
You may not use the App for any illegal or unauthorized purpose. You agree not to:
- Decompile, reverse engineer, or disassemble the App.
- Use the App to harass, abuse, or harm another person.
- Interfere with or disrupt the Service or servers/networks connected to the Service.
- Attempt to bypass any measures we may use to prevent or restrict access to the Service.
7. Subscription and Billing
Some parts of the Service are billed on a subscription basis ("Subscription(s)").
- Billing: You will be billed in advance on a recurring and periodic basis (such as monthly or annually).
- Cancellation: You may cancel your Subscription at any time through your App Store (Apple App Store or Google Play Store) settings. Your subscription will remain active until the end of the current billing cycle.
- Refunds: Refunds are handled by the respective App Store policies.
8. Limitation of Liability
In no event shall Caloria, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use or alteration of your transmissions or content.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
